These projects ranged from sidewalks and school buildings to dams. According to the court, the federal government, especially the president, had assumed powers that the United States Constitution did not grant.
In particular, the first part of the NIRA allowed the federal government to regulate businesses that did not engage in interstate commerce. Unfortunately for the workers, most of these people were unskilled, and the AFL only accepted skilled workers.
As a result of the AFL's unwillingness to accept unskilled workers, these employees formed their own unions to seek better working conditions and wages. Schechter Poultry Corp with violating codes established under the National Industrial Recovery Act that had created rules regarding the sales of healthy and sick poultry. Schecter had been charged with breaking those rules. Their grounds were twofold; the first that the rulemaking had been an unconstitutional delegation of powers from the Congress to the Executive Branch.
Furthermore, they claimed that the commercial activity at question was local in nature and that the ability to regulate local power resided in the states and not in the Federal government. The ruling stated that only if the commerce had direct involvement in interstate commerce could the federal government interfere.
The administration asked businesses to display the blue eagle logo, an emblem signifying NRA participation, as an act of patriotism. But to many people, the program was more like an albatross. The overly ambitious NIRA had something to anger most business and societal interests.
It allowed for the suspension of antitrust laws and forced certain industries to align.
